Technically then, it is illegal, but in practice it is not...like the speeding analogy I made in the other thread.I think if you burn the Tokyo DVDs or Welcome to the Videos, and then sell those, you are asking for trouble. These are DVDs that are officially released, i.e. Geffen makes money off them. And the albums too of course, and whatever else I might be forgetting that is official. You would be cutting into their profits and thus pissing them off.But all the other stuff they aren't making money from. So what do they care if people sell/trade those concerts? In fact it probably helps the band by keeping fan interest high.And as gnr>everything said (love that name btw), ebay probably has that policy in place in the unlikely event they are sued by Geffen for allowing those DVDs. They can point to it and say that they never condoned it and tried to discourage it.That's just my take on things. I could be wrong but I think it's the only logical explanation.
