Isn't  Diana Ross dead?

It occured to me that you might be thinking of Aretha Franklin. She died in 2018. 🤔 Ariana Grande showed up to Aretha's Funeral with a short, tight,  black dress like she was going to a nightclub and some Pastor was hugging her inappropriately or something like that while she looked uncomfortable. 😵‍💫 I  remember people saying something like,"Poor Aretha. Her Funeral was so disrespectful to her. She deserved a better funeral. 💡

Did the questioning happen on the 26th? Or was that changed, do we have any updates?

I think it's likely it didn't happen since there is a motion pending.

I don't think depositions are included in the public document filings for a case (especially the content of what a witness said), so we'll probably won't know.

Goddamnit, Axl had his Friend, Lisa Marie Presley die  and then he got hit with a sexual assault lawsuit in the same year. 😫 How incredibly fucked up was 2023 for him! 😫

Okay, makes sense that you got Donna Summer and Diana Ross mixed up. 💡 Poor Donna Summer died at 63 from getting lung cancer after breathing toxic dust/chemicals/fumes from the 9/11 attacks. 😫😵‍💫🥶😱😳 She could have STILL been alive today at 75  had 9/11 never happened. 😫

I read somewhere that if anything, the Axl Rose Sexual Assault Lawsuit Trial will start October 2025. It could end in October 2026 for all we know. Hopefully Sheila will end up looking like Amber Heard in the Lawsuit Trial. 💡🤔

Most likely there won't be a trial. And even if there is, it won't start so late.

Sheila now has only two days left to file her opposition to Axl's motion to have the case dismissed. I assume she will, but time is running short.

From what I've seen from looking at dockets of various cases, oppositions, responses etc. are usually filed on the day the deadline expires. So I expect it the day after tomorrow.

The case has been assigned to a woman judge, which could hypothetically be of some benefit to Sheila. It doesn't guarantee the outcome she's hoping for (obviously), but it could make the process less traumatizing.

"If a sexual assault case is before a woman judge, it is reasoned that there is less chance of bias against the woman, less chance that she will be abused by opposing counsel, and a greater chance that she will be heard instead of silenced."

I figure they might be deliberately filing at the last moment to give Axl less time to reply, since there's already a set date by which he has to reply to Sheila's opposition to the motion.

Yes, but like I said, this is common practice. All lawyers do that, so most of the time the due date is the actual filing date.

Kennedy's lawyers have the option to file an amended complaint (on the same due date) instead of an opposition without the two of the four causes of action that Axl's motion asks to be dismissed (which, or at least one of them, are very likely to be dismissed, I think, because there are precedents in other cases with the Steven Tyler NY case being the most recent). That would make Axl's motion to dismiss the entire complaint due to improper service redundant, as he would now be served with the amended complaint.

Kennedy's lawyers have filed the opposition to Axl's motion:

or

https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=A_PLUS_Y556T3YllOkkHY0nmZ0g==&system=prod

It is accompanied by the affidavits or service and information about Axl's companies and business addresses (I suppose to show that they made all efforts to trace Axl's addresses).

I was a bit surprised at the wording they used, it did not sound very professional in my opinion. I know that means absolutely nothing lol, but I was not expecting to see the actual definition of a door in a legal document, but lawyers are going to lawyer I guess

In the preliminary statement of the opposition it is mentioned that the schedule of fact discovery for the case (depositions etc.) which should be completed by October 2024, was proposed by Axl.

They say in the opposition that Axl doesn't contest that Malibu is his main residence. But he has contested that in his answer.

There is also an attached document of skip tracing Axl's locations (they say they hired an investigator for that):

https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=h1FtNpHOXPQULQkRi0bTXw==&system=prod

The last traced date of residence in Malibu is January 2020. There is a later date (April 2020) of residence in Montana but there are traces only for that one day.

It was Axl's side that started this nonsense with their claim that a gate is not a door, so of course it had to be addressed. In my opinion, Sheila's attorneys did an excellent job, whereas Axl's attorneys come across as lawyers at their worst, grasping at every technicality.

Putting the Webster dictionary of what a door is in a legal document is still goofy lol
